A quick scan of the criminal code suggests it's based off what tarrif you should have paid (smuggling goods act) Tariff 10000-500000,3年以下 500000-2500000,3-10年 2500000以上,10年以上 Others factors too such as your position in the operation, nature of the product, e.g baby milk powder , dangerous material She hasn't seen anything that says you can have home detention but didn't have time to go throw the code. She always stresses that chinese law has a lot of scope for interpretation and a lot of "catch all" elements . It changes regularly much to the frustrating of students who fail exams and are faced with a big change to the syllabus in the repeat exams.
